This article aims to understand what does the duty of utmost good faith (uberrimae fidei) in insurance contract mean for the construction industry. In construction insurance contracts, the duty of utmost good faith (uberrimae fidei) plays an important role. The analysis of case law shows that an insurer has the right in law to avoid the contract of insurance in its entirety if the insured was guilty of fraud, non-disclosure or misrepresentation before the contract was entered into. It seems to be unjust because even though the insured may be honest, he could still be in breach of duty. Utmost here means that both the insurer and the insured have the duty beyond the reasonable integrity and honesty. Furthermore, the insurer may also have a claim in the case of a breach of utmost good faith during the contract. It proceeds on the basis that the insurer likewise owes the insured a duty of good faith. While sounding good in theory, it can be argued that it may mean very little in practice. In the last decade, the English courts are turning their eyes towards the mutuality of the duty of good faith owed by the insurers to the insured. There is a new practical focus in the construction industry on inducement to balance the risk on the insured and insurer, where the mutuality of the duty of good faith is shifting towards the obligations on the insurers.

Is expert witness immunity from suit a thing of the past in construction law? This article explores whether immunity for expert witness should be abolished or not;whether there is a need to distinguish between immunity from suit from actions in negligence, and immunity from suit from actions in defamation. The analysis from case law shows that it is most likely that in the future, immunity will be largely curtailed. It may be considered just and fair for immunity from suit to remain a significant legal and moral obligation for expert witness in view of human rights and right to a fair trial, although we can see there is evidence of a change in the concept of immunity. It can be argued that parties should ensure they employ competent experts to give them appropriate advice, experts should be accountable for the evidence they provide for the court at trials, and immunity from suit should not be enjoyed by expert witness if Article 6 of the European Convention on Human Rights on the right to a fair trial cannot be upheld. Therefore, it is necessary for the courts to modernise their approach to this particular area of law, and to comply with Article 6 of the European Convention on Human Rights. However, it can be argued that if immunity from suit is removed, very few experts will be prepared to be an expert witness for fear of being liable for negligent evidence. In most circumstances, it would be challenging to please the clients as well as carrying out the overriding duty to the court simultaneously. It makes more sense for the expert witness immunity from suit to be maintained but establishing criteria for departures instead of granting blanket immunity.

Many health problems are generally caused by unhealthy behaviours that occur whilst conducting everyday Activities of Daily Living (ADL), such as poor use of sanitation and hygiene. This paper describes the development of an ADL inference engine, which is able to recognise natural hygiene behaviour patterns. As opposed to traditional ADL classification approaches, the developed inference engine employs a novel hierarchal structure for the modelling, representation and recognition of the ADLs, its associated tasks, objects, dependencies and their relationships. The organisation of this information in a contextual structure plays a key role in carrying out robust ADL recognition for the detection of hygiene behaviours. The proposed work also marks a shift in feature detection methodology, as it allows actual behaviour to be studied in its natural environment within actual households, with at least two individuals per household as opposed to a laboratory based controlled setting. This paper also presents experimental results that validate the performance of the inference engine.

Documentation quality is of high importance for any procurement method, however for a managing contract type procurement it is particularly important as there is limited time to issue and fine tune the finalised drawings for tender without the potential to halt concurrent works. It is the quality of the finalised documentation during this construction phase that generally dictates the final outcomes of a project. This research adopted a qualitative approach to investigate documentation quality issues in construction projects. Selected industry professionals in South Australia were interviewed, followed by a case study. The results showed that choosing an appropriate procurement approach plays a critical role to improve the documentation quality. In particular, the risks associated with management contracting in terms of documentation quality are highlighted. © 2014 Springer-Verlag Berlin Heidelberg.

Currently, automated learning systems are widely used for educational and training purposes within various organisations including, schools, universities and further education centres. There has been a big gap between the extraction of useful patterns from data sources to knowledge, as it is crucial that data is made valid, novel, potentially useful and understandable. To meet the needs of intended users, there is requirement for learning systems to embody technologies that support learners in achieving their learning goals and this process don’t happen automatically. This paper propose a novel approach for automated learning that is capable of detecting changing trends in learning behaviours and abilities through the use of process mining techniques. The goal is to discover user interaction patterns within learning processes, and respond by making decisions based on adaptive rules centred on captured user profiles. The approach applies semantic annotation of activity logs within the learning process in order to discover patterns automatically by means of semantic reasoning. Therefore, our proposed approach is grounded on Semantic Modelling and Process Mining techniques. To this end, it is possible to apply effective reasoning methods to make inferences over a Learning Process Knowledge-Base that leads to automated discovery of learning patterns or behaviour.

The KM3NeT research infrastructure being built at the bottom of the Mediterranean Sea will host water-Cherenkov telescopes for the detection of cosmic neutrinos. The neutrino telescopes will consist of large volume three-dimensional grids of optical modules to detect the Cherenkov light from charged particles produced by neutrino-induced interactions. Each optical module houses 31 3-inch photomultiplier tubes, instrumentation for calibration of the photomultiplier signal and positioning of the optical module and all associated electronics boards. By design, the total electrical power consumption of an optical module has been capped at seven watts. This paper presents an overview of the front-end and readout electronics system inside the optical module, which has been designed for a 1 ns synchronization between the clocks of all optical modules in the grid during a life time of at least 20 years. A neural network based security tool for analyzing software

The need to secure software application in today’s hostile computer environment cannot be overlooked. The increase in attacks aimed at software directly in the last decade and the demand for more secure software applications has drawn the attention of the software industry into looking for better ways in which software can be developed more securely. To achieve this, it has been suggested that security needs to be integrated into every phase of software development lifecycle (SDLC). In line with this view, security tools are now used during SDLC to integrate security into software applications. Here, we propose a neural network based security tool for analyzing software design for security flaws. Our findings show that the trained neural network was able to match possible attack patterns to design scenarios presented to it. With the information on the attack pattern identified, developers can make informed decision in mitigating risks in their designs. © IFIP International Federation for Information Processing 2013

Slime mould Physarum polycephalum is a single cell that is visible by the unaided eye. When spanning sources of nutrients the slime mould builds a network of protoplasmic tubes which is sometimes considered to be optimal in terms of the minimization of metabolite transportation time and distance away from repellents. Previously we have shown that the slime mould is efficient in imitating the formation of man-made road networks in major countries, where major urban areas are sources of nutrients. We used a similar approach to grow slime mould on a three-dimensional template of the Moon to speculate on potential colonisation scenarios. The slime mould imitated the propagation of colonisation in an exploratory mode, i.e. without any definite targets. Additional transportation hubs/targets were added after the initial network was formed, to imitate the development of colonies in parallel with slime mould growth. We provide analyses of proximity graphs representing colonisation networks and support the findings with Physarum-inspired algorithms to inform supply chain design. We speculate on how living Physarum, or its incorporation into a polymer hybrid material, can be used as a wearable smart wetware based on laboratory experiments interacting with chemical components.

We propose a hybrid approach to foreign accent recognition combining both phonotactic and spectral based systems by treating the problem as a spoken language recognition task. We extract speech attribute features that represent speech and acoustic cues reflecting foreign accents of a speaker to obtain feature streams that are modeled with the i-vector methodology. Testing on the Finnish Language Proficiency exam corpus, we find our proposed technique to achieve a significant performance improvement over the state-of-the-art systems using only spectral based features.

Future heterogeneous systems will integrate CPUs and GPUs on a single chip to achieve high computing performance as well as high throughput. In general, it would discard the current discrete pattern and will build a uniformed shared memory system avoiding explicit data movement among CPUs and GPUs connected by high throughput NoC. We propose a scalable cache coherence solution Fusion Coherence for Heterogeneous Kilo-core System architecture by integrating CPUs and GPUs on a single chip to mitigate the coherence bandwidth side effects of GPU memory requests as well as overhead of copying data among memories of CPUs and GPUs. The Fusion Coherence coalesces L3 data cache of CPUs and GPUs based on a uniformed physical memory, further integrates a region directory and cuckoo directory into two levels of cache coherence directory without modifying cache coherence protocol. According to the experimental results with a subset of Rodina benchmarks, it is effective to decrease the overhead of data transfer and get an average execution speedup by 2.4x. The highest speedup is approximate to 4x for data-intensive applications. © Springer-Verlag Berlin Heidelberg 2014.
